1. Acceptance of Terms

By downloading, installing, or using the WhisKey application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you disagree with any part of these terms, you may not use our App.

2. Description of Service

WhisKey is a privacy-first voice dictation application for iOS devices that processes speech-to-text conversion entirely on your device using advanced AI technology. The App includes:

• • Custom keyboard extension for system-wide integration
• • Multiple AI model options for speed and accuracy preferences
• • Multi-language support (12+ languages)
• • Dynamic Island integration with Live Activities

3. Privacy and Data Processing

WhisKey is designed with privacy as the fundamental principle:

• • No Data Collection: We do not collect, store, or transmit any personal data, voice recordings, or transcribed text
• • On-Device Processing: All voice processing occurs locally on your device using Apple's secure enclave
• • No Internet Required: The App functions completely offline for transcription
• • No Analytics: We do not use any analytics or tracking services
• • No Third-Party Services: The App does not connect to any external services for voice processing

4. User Responsibilities

When using WhisKey, you agree to:

• • Use the App only for lawful purposes
• • Not attempt to reverse engineer, decompile, or modify the App
• • Respect intellectual property rights
• • Not use the App to transcribe copyrighted content without permission
• • Ensure you have appropriate permissions when recording in shared spaces

5. Device Requirements and Compatibility

WhisKey requires iOS 16.0 or later and is compatible with iPhone and iPad devices. Optimal performance requires devices with sufficient processing power and storage space for AI models.

6. AI Model Accuracy

While WhisKey strives for high accuracy in voice transcription, we cannot guarantee 100% accuracy. Transcription quality may vary based on:

• • Speaking clarity and pace
• • Language and accent variations
• • Selected AI model size and capabilities
• • Device processing power

7. Intellectual Property

WhisKey is built using the open-source whisper.cpp library. The App interface, branding, and implementation are proprietary. Users retain full ownership of any content they create using the App.

8. Limitation of Liability

WhisKey is provided "as is" without warranties of any kind. We shall not be liable for any damages arising from the use or inability to use the App, including but not limited to:

• • Transcription errors or inaccuracies
• • Data loss or corruption
• • Device performance issues
• • Business or personal losses

9. Updates and Modifications

We may update the App and these Terms from time to time. Significant changes will be communicated through App Store updates. Continued use of the App after updates constitutes acceptance of revised Terms.

10. Termination

You may stop using WhisKey at any time by deleting the App from your device. Since we collect no data, there is no account to close or data to delete on our end.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where WhisKey is developed, without regard to conflict of law provisions.

WhisKey incorporates the following open-source components:

• • Metal Performance Shaders: Apple's GPU acceleration framework
